Unregulated Will-writers The Legal Ombudsman has been warning customers of will-writers that they may be left with no legal recourse in the event the service they receive is not up to the standard expected, as reported widely in the press recently. Will-writers are not regulated by any professional body and those working for them do not necessarily have the legal expertise required to draft Wills for clients. In a day and age where there is so much choice and variation of fees, it is important when considering who you instruct to prepare your Wills, you consider what recourse you have and whether the advice you are receiving is good value. The Legal Services Board is in discussions as to regulating will-writing, but until this is done consumers are left with little or no protection if the advice given is wrong. Our advice before preparing your Wills, is to take careful consideration of the qualifications of the person doing the work and what their fees include.
