Supermarket Test Case for Equal Pay

If the claim is successful, the staff may be eligible to claim back six years' worth of pay from Asda. The proceedings will establish if pay discrepancies exist within Asda's equal value jobs.

The case is due to be heard within the next two months by the Manchester employment tribunal, and if successful, could potentially open the floodgates for other supermarket staff, such as Tesco, Morrisons, Sainburys, Marks & Spencers and John Lewis, to make similar claims.

Until recently, equal job evaluation claims have mainly affected local councils.  Local council evaluate each position and assign a particular pay grade. The precedent was set for claims in relation to equal value jobs in 1997 when 1,500 Cleveland dinner ladies were compensated in the region of a £5 million.
